Code Change Process:

Arizona is a home rule state, thus codes are adopted and enforced on a local level. The State Energy Code Advisory Commission reviews the state energy code through an open, voluntary and consensus process, performs cost-benefit analyses of potential state incentives for the use of energy saving devices and methods, and provides annual reports on its findings. At present, statewide adoption of an energy code, residential and/or commercial, must be mandated by the legislature.

History

In 1999, the Joint Legislative Energy Efficiency Code Study Committee was formed by the Arizona legislature to discuss possible adoptions of energy efficiency codes. As a result of the Committee's recommendations, the Arizona Legislature introduced and enacted in the 1999 legislature House Bill 2322.

Based on the results of these efforts, the state legislature subsequently passed HB 2541 on May 4, 2001, which resulted in Arizona Law 2001, Chapter 340. This statute established the Arizona State Energy Code, and further established a State Energy Code Advisory Commission to review and recommend changes to the State Energy Code. No mandatory statewide code has been promulgated by this body as of 2009. In addition, legislation adopted in 2003 requires state agencies and universities to achieve a 10% reduction in energy use per unit of floor area by 2008, and a 15% reduction by 2011.

On February 11, 2005, Gov. Janet Napolitano signed Executive Order 2005-05, requiring all new state-funded buildings constructed after February 11, 2005, to achieve at least a Silver LEED green building rating as well as meet the energy standards of ASHRAE 90.1-2004.

Climate Concerns

Regional Issues & State Action:

According to the United States Global Change Research Program, the Southwest is one of the fasted warming regions in the United States which is resulting in less spring snowpack and weakened Colorado River flow. Annual average temperature increases are projected as a result of climate change with the greatest increases occurring in the summertime. Climate change will continue to negatively affect the water supply to the Southwest region and could result in severe drought.

Arizona’s Climate Change Advisory Group (CCAG) was established by Governor Napolitano’s Executive order on February 2, 2005. The CCAG was responsible for completing an emissions inventory in 2005 and creating a Climate Change Action Plan which was finished in August 2006. Arizona’s current efforts include incentives for energy efficient buildings and updating the energy code. In addition, Arizona is a member of the Western Climate Initiative, which aims to reduce emissions by 15% below 2005 levels by 2020.

BCAP Estimated Energy Savings

If Arizona began implementing the 2009 IECC and Standard 90.1-2007 statewide in 2011, businesses and homeowners would save an estimated $99 million annually by 2020 and $199 million annually by 2030 in energy costs (assuming 2006 prices).

Additionally, implementing the latest model codes would help avoid about 30.2 trillion Btu of primary annual energy use by 2030 and annual emissions of more than 1.72 million metric tons of CO2 by 2030.

A 2010 BCAP analysis indicates that the weighted average incremental construction cost of upgrading to the 2009 IECC in Arizona would be $,559.49 per home. On average, the annual energy savings per home would be $217.00, meaning the simple payback for homeowners would occur, on average, in 2.58 years. These estimates are conservative and represent the upper bound on incremental cost.
